The Police Oversight Panel today issued a clarifying statement about its ongoing discussion related to whether it will re-open old cases. Here is that statement:
“The Boulder Police Oversight Panel would like to make clear that no final determination has yet been made on whether or not the panel will review past investigations that have already been completed. The panel has provisionally approved the concept of a Legacy Review Committee, which could potentially review past practices, as well as, in extraordinary circumstances, previously closed cases. However, it is not clear whether the current police oversight legislation (ordinance 8430) allows the panel to review cases that have already been adjudicated and closed. The panel is in the process of acquiring legal advice on this matter. The panel by-laws will be posted for public review and comment prior to the panel’s final adoption of its by-laws.”
