Gaining SmartRegs Compliance

If an inspection or HERS rating has revealed that a rental property is not SmartRegs compliant then you'll need to make improvements to the property until a passing score is obtained.

There are Options

Talk to your SmartRegs inspector or HERS rater and review your results to understand the efficiency improvements that you need to make to become compliant. Over the last eight years, the most common upgrades completed to reach compliance have been:

  • Attic insulation
  • Crawl space insulation
  • Wall insulation

Other areas which may have room to gain a large number of points are:

  • Heating and cooling equipment
  • Windows
  • Duct leakage and infiltration testing

After Making Improvements

If you are compliant

For the Prescriptive Path make sure that your inspector updates your score based on the completed improvements. Compliance requires 100 energy efficiency points and 2 water conservation points.

For the Performance Path make sure that your HERS rater updates your rating based on the completed improvements. Compliance requires a HERS rating of 120 or less.

Finally, make sure your rental license application exhibits that SmartRegs compliance has been obtained for the rental property.

Technically Impractical Consideration

If you have completed all of the possible improvements, but the rental property has not reached compliance then you can pursue a special consideration called Technically Impractical.

All eligible upgrades and testing must be performed to be considered for this exemption.

  • If approved for an exemption, an energy offset purchase will be required as part of the approval process. SmartRegs services fees and enforcement fees/penalties will not be applied to a rental license during the review process.
  • If not approved for an exemption, all fees and or penalties will apply. Incomplete applications will be returned for updates prior to review
