Development Review Application Requirements

This is a list of the required items needed to submit a complete application for Development Review. The Development Review Application Guide gives details on the application process.

Architectural Floor Plans and ElevationsProvide plans of the existing structure(s) and any proposed additions or renovations, drawn at a standard architectural scale sufficient to show the details of the drawing, including the maximum height of all buildings measured per the requirements of Title 9 - Land Use Code, B.R.C. 1981, and building elevations showing exterior colors and materials and any anticipated roof top appurtenances.
Drawings/Diagrams Provide drawings and/or diagrams that illustrate clear compliance with the Form-Based Code requirements. These must clearly show calculations for required FBC elements. For example, transparency, roof cap types, exterior materials, building massing, etc.
Legal DescriptionProvide the legal description of the subject property.
Persons in InterestProvide a completed Persons in Interest Form.

SurveyAn improvement survey or improvement location certificate by a registered surveyor of the subject property.

The site plan should be based on an improvement survey or improvement location certificate for the property. Include a parking plan showing the dimensions and locations of all parking spaces, drive aisles and the abutting alley width, if applicable.

The written statement should also include clear and detailed responses on how exactly the application meets each applicable solar exception review criteria. Criteria responses should be individual and detailed, explaining how exactly each of the criteria is met and not just stating it is met. Site Development Plans & Actual Shadow Analysis Site development plans, drawn to an identified scale showing the major details of the entire property as well as the specific project, including the location and setbacks of existing and proposed buildings/additions. The site plan - or an affixed solar access exhibit - should include an actual shadow analysis showing where the actual or real (not adjusted) shadow(s) project onto all impacted properties specific to the solar exception request. The information on this site plan must be accurate and is typically based on an improvement survey or improvement location certificate for the property.
Floor Plans and ElevationsFloor Plans and Elevations of the existing structure and any proposed additions, renovation, or new structures. If new exterior construction is proposed, also include elevation drawings of the existing structure, and proposed construction.
Affected Owner ApprovalWritten Approval from the affected adjacent property owners of the solar exception request. Approval may be indicated either in the form of a signed letter of authorization or signatures on proposed plans. When determining affected property owners of a solar exception, any property that is impacted by the actual/real (not just adjusted) shadow resulting in the need for a solar exception shall be required to provide written approval at time of application submittal. Applicants should contact Planning and Development Services for questions regarding determination of affected owners.

Applicants should contact Planning and Development Services for questions regarding determination of affected owners.

Label the map with a header of "Exhibit A" and include a subheading which says, "Page X of X". Include crosshatching in the easement area to be vacated (for clarity when copying document) and the total area of easement to be vacated. Please note that the map must be copied to scale.

Revocable Lease/Permit: If alcohol will be served on a patio located on the public right-of-way (e.g. a patio on a sidewalk), you must obtain a revocable license. Please visit the Revocable Permits and Leases webpage for information on how to apply.

PlansProvide plans of the indoor square footage, per Floor Area definition in BRC 9-16, which will represent the area to be licensed for liquor. Include the seating layout, as applicable; show all bars, tables and chairs, and booths. Each plan sheet must be drawn to a standard scale and should include a north arrow. All areas intended to be included in the liquor license must be outlined with a solid bold, black line. Include separate sheets for each floor that will be licensed. Indicate the overall and individual room dimensions (in feet and inches), including the width of doors and walls. Label the following: locked and unlocked alcohol storage areas, points of sale, where alcohol receipts, books and records will be stored on site, and for restaurants, kitchen should be marked as “kitchen” with kitchen equipment listed. For Patios: show means of control (fencing, stationed employees, landscaping, etc.). If enclosed by a gate/fence, include the height and material.

Traffic Circulation and Parking Plan A separate site plan, at a scale of not less than one inch equals one hundred feet, illustrating the internal vehicular, pedestrian, and bicycle circulation systems, transit station locations within 300 feet of the site, on-site transit amenities, off-street vehicular and bicycle parking areas, service areas, loading areas and major points of access to public rights-of- way, and how the project connects to its surrounding context.
Natural Feature Plan Plans for preservation of natural features existing on the site or plans for mitigation of adverse impacts to natural features existing on the site from the proposed development and anticipated uses. Natural features include, without limitation, healthy long-lived trees, significant plant communities, ground and surface water, wetlands, riparian areas, drainage areas and habitat for species on the federal Endangered Species List, "Species of Special Concern in Boulder County" designated by Boulder County, or prairie dogs (Cynomys ludiovicianus) which is a species of local concern.
Tree Inventory A tree inventory prepared by a certified arborist that has a valid contractor license, and contains all the elements listed in BRC 9-2-16(d)(13)

Renderings and Sketches Renderings and sketches of the proposed development with several different perspectives, including from the pedestrian point-of-view. (Include in the Architectural Plan Set).
Landscaping PlanA landscaping plan set showing the spacing, sizes, specific types of landscaping materials, quantities of all plants and whether the plant is coniferous or deciduous. Plan set should include a Planting Plan, Tree Protection Plan, Irrigation Plan, and Tree Inventory. Tree Inventory should include the location, size, species and general health of all trees with a diameter of six inches and over 54 inches tall on the property or in the landscape setback of any property adjacent to the development. The inventory shall indicate which trees will be adversely affected and what if any steps will be taken to mitigate the impact on the trees. The tree inventory shall be prepared by a certified arborist with a valid contractor license.
Open Space Diagram An open space diagram and table that indicates what aspects of the site count towards open space and include citations of specific code criteria (“Useable Open Space”). Site Development PlansA complete site development plan set prepared at a standard engineering scale sufficient to clearly show the details of the drawing and with a north arrow and scale on each sheet. The site plan set may contain more than one sheet but should show elements of the development, including without limitation: Site topography showing contours at two-foot intervals; setback diagram (show proposed modifications if applicable); The location and size of all existing and proposed buildings, structures, and improvements, and the general location of adjacent streets, structures, and properties; The low point within 25 feet of each structure (see BRC 9-7-5 Building Height); Site circulation diagram including pedestrian, vehicle, bike, and ADA users. Label parking areas, service areas, loading areas, and access to public rights-of-way; The areas that are to be conveyed, dedicated, or reserved for streets, alley, utility easements, outlots, parks, open space, etc.; The areas subject to the one-hundred-year flood as defined in Section 9-3-3, "Regulations Governing the Floodplain," and any area of the site that is within a designated conveyance zone or high hazard zone.
Solar Shadow Analysis PlanA shadow analysis for existing and proposed buildings that that meets the criteria set forth in BRC 9-9-17 and the Solar Access Guide & Calculator.
SurveyAn improvement survey or improvement location certificate by a registered surveyor of the subject property.
Title InsuranceA current title insurance commitment or attorney memorandum, based on an abstract of title, current to within 30 days.
Travel Demand Management Plan (TDM)Provide a TDM plan which outlines strategies to mitigate traffic impacts created by the proposed development and implementable measures for promoting alternate modes of travel. See BRC 9-2-14(d) and City of Boulder Design and Construction Standards 2.03(I) for specific requirements.
Utility PlanProvide a utility plan or utility connection plan, depending on whether public improvements are required, showing the proposed changes in redline form, for private and public utility systems including water, sewer, electric, gas, drainage, telephone, telecommunications, and any other services that will supply the property. See the City of Boulder Design and Construction Standards, Chapter 4 for specific requirements.
Utility ReportProvide a final utility report.
Vested Property Rights Option Form Provide a completed and signed Vested Rights Options and Waiver.
Vicinity MapA vicinity map showing the property and an area not less than a 300 foot radius around the property, indicating all the street names within the radius.
Written Statement A written statement that includes the following: An explanation of the proposal, objectives, and key elements including but not limited to architectural design intent, planned open space, site programming, transportation context, etc. A detailed analysis on how the application meets each applicable criteria found in Boulder Revised Code Section 9-2-14(h). If the project is developed in phases, describe what is to be included in each phase and expected start and completion dates.

Height Modification - Digital Model If requesting a height modification in a Downtown (DT) district, provide a digital model, at a scale of no less than one inch equals 30 feet, of the proposed building and all buildings and property within 100 feet of the proposed project.
Height Modification - Street Level IllustrationIf requesting a height modification in a Downtown (DT) district, provide an illustration of the proposed building shown from street level demonstrating the pedestrian view, including without limitation, a perspective, computer model, or photographic montage.
Height Modification - Solar Shadow Analysis Plan If requesting a height modification, provide a shadow analysis, as described in the solar analysis instructions provided by the city manager, that shows the shadow cast by a 35-foot building located at the required setback and the shadow cast by the proposed building.
Height Modification - Height List If requesting a height modification, provide a list of the height of each principal building located or known to be proposed or approved within 100 feet of the proposed project.
Height Modification - Pedestrians Statement If requesting a height modification, provide a written statement and drawings which describes the way in which the proposal accommodates pedestrians, including without limitation uses proposed for the ground level, percent of transparent material at the ground level, and signage and graphics.
Height Modification - Open Space PlanWhen additional open space is required by code due to building height, include a detailed plan showing the location of all useable open space and a written statement of how it serves the public interest.
Subdivision Preliminary Plat A preliminary plat drawn to a scale of no less than one-inch equals one hundred feet, and of a scale sufficient to be clearly legible, including streets and lots adjacent to the subdivision, and required information in the Preliminary Plat Application section of the Subdivision Code Criteria, BRC 9-12-6.
